S206 disclosures will be ending soon and from 1/08/2025 a Form 2 Seller Disclosure Statement will need to be given to the buyer prior to any contracts for sale of property being entered in Queensland.

Prices shown below include GST and all disbursements unless specifically noted. Further notes about what is included is shown before the initial prices. Please read this important information.

Timeframes given are only a guess at this stage. Much will depend on how the various providers react to sudden demand and ease with which orders are fulfilled.

Keeping all that in mind … our offerings and pricing are as follows:

Option 1: Search of Body Corporate Records only

OPTION 1 – Implied Warranty and other body corporate information

Despite the change in disclosure statement sellers still need to meet statutory requirements per section 223 BCCM Act, specifically latent and patent defects commonly referred to as Implied Warranties.

Choose this search if you are preparing/sourcing your own seller disclosure statement and want additional body corporate information such as minutes of meetings, Sinking Fund Forecast, or other body corporate information.

An implied warranty statement will be included, however that statement will reference and attach copies of documents attached. We will not be reviewing the contents of the documents and writing statements as previously done. Written statements are time consuming and repetitive.

You may request any documents you would like with this search but we will have standard documentation we collect for implied warranty statement.

Turnaround times will be dictated by the strata manager for the subject scheme. Legislation allows 7 days from request and some managers will use all that time. Typically most searches will be completed within 3 – 5 business days.

OPTION 2 – Full Form 2 Seller Disclosure Statement for lots in a body corporate

This is a completed form 2 seller disclosure statement including attachments ready for handing to any buyers.

Choose this option if you prefer to have the disclosure provided to you in full.

To complete this search at this price the seller must provide authority and certain searches at time of order. Additional information must be provided by the owner prior to search including:

• Declaration of any unregistered encumbrances
• Advice regarding leasing of the property
• Advice regarding any tree applications received / made
• Advice regarding any unsatisfied show cause notice or enforcement notices issued or notice from local or State or Commonweath government, a court or tribunal, or other competent authority
• A copy of the most recent rates notice
• A copy of the most recent water services notice

If this information cannot be provided, then additional searches may be required and if that is the case additional search costs will be added. My next article will be further discussion about ordering the seller disclosure statement and what we require.

This search and pricing is based on completion of the disclosure and the following searches being carried out:

• Title search and survey plan
• Search Before you Dig to identify statutory encumbrances
• Relevant zoning ascertained
• A transport search
• Contaminated land and environmental protection search
• Tree orders search

Turnaround times will be variable for this search based on what information needs to be obtained. I have estimated 5 days based on time allowed for completion of body corporate certificate but at this stage this is an estimate only.

If implied warranty information is required, an additional search of body corporate records may also be added.

OPTION 3: Body Corporate Certificate and CMS

Choose this option if you only need the body corporate portion of the seller disclosure statement.

We will deal with the strata manager directly and order body corporate certificates on your behalf.

All body corporate certificates will be sourced from the relevant strata manager for the subject scheme and be provided as produced by them. We will not have any option to amend documentation.

All body corporate certificates will be ordered on an urgent basis (24 hours). This option exists in the legislation however there is no requirement for the body corporate to fulfill that obligation. They simply need to refund the fee paid for urgent if they cannot supply. Although ordered urgently we cannot guarantee they will be supplied urgently.

Body corporate certificates should be accompanied by the by-laws of the scheme. This may or may not be the full CMS depending on how the strata managers provide the information. Legislation requires the most current CMS be included so we will be taking control of that process to ensure accurate documents are provided.

Every body corporate certificate will be accompanied by a dealing search. This gives the dealing number of the current CMS document and allows already held documents to be checked for compliance. You may already have the current CMS on file and will not therefore need to order another.

If a CMS is provided by the strata manager, and is clearly the most current document nothing else is required.

If the full CMS is not provided, or the document is not the most current you will be given the option to upgrade to include the correct CMS.

Along with ordering a body corporate certificate and CMS you may also order a search of records to obtain implied warranty or other body corporate information.

OPTION 4: Build Your Own Search

Choose this option if you’re only after one or two different documents.

This is a once-off fee you will be charged for all the searches that can be requested within an hour. Disbursement fees, if applicable, will be billed on top of search cost.

For instance, if you want a Before you Dig search to check statutory encumbrances for an address. You would order this search and be charged the once-off service charge plus any disbursements for the job.

This excludes searches of body corporate records as they take longer to execute than one hour however include order of a body corporate certificate if requested.

Just a final note: this is a whole new experience, for everyone. I have designed these options / prices to reflect what I think will best match needs of sellers and those acting for them and what we can provide. But we haven’t actually produced anything yet so as we go along things may change.
